Development Impact Fees

Development Impact Fees - Effective 1/1/2025

Development Impact Fees (DIF) are fees applied to address the cumulative impact a project has on several public services including general facilities, police, parks, transportation, water, sewer, and storm drain. Request for Total Amount of Fees and Exactions

The bill would require a city or county to request the total amount of fees and exactions associated with a project upon the issuance of a certificate of occupancy or the final inspection, whichever occurs last, and to post this information on its internet website, as specified. 

PLEASE COMPLETE THE FORM BELOW (ONE PER PERMIT, NOT COLLECTIVELY AS A PROJECT): 

“Housing development project” means a use consisting of any of the following:

  1. Residential units only.
  2. Mixed-use developments consisting of residential and nonresidential uses with at least two-thirds of the square footage designated for residential use.
  3. Transitional housing or supportive housing.

In accordance with California Government Code section 65940.1(a)(3)(A) and (B), please provide the total amount of fees and exactions for your project.
The total amount should consist of the following:

All fees charged, EXCEPT for:

  • Water and sewer connection and capacity charges
  • School fees

Exactions, including:

  • Construction excise tax
  • A requirement that the housing development project provide public art or an in-lieu payment
  • Dedications of parkland or in-lieu fees imposed
  • Mello-Roos or other taxes (CFD taxes)

The City will post this information on our internet website and update it at least twice per year.

Fee Application Requirements

As required under AB 516, agencies must provide the following information to an applicant requesting Development Impact Fees:

  1. You have the right to request an audit of development impact fees pursuant to Government Code section 66023.
  1. You have the right to file a written request to receive a mailed notice of the City of Upland’s annual report review meeting.

Audit Requirements

Prior law authorized a person to request an audit to determine whether a local agency’s fee or charge “exceeded the amount reasonably necessary to cover the cost of a product, public facility, or service provided by the agency”.  AB 516 allows a person to request an audit to determine when the revenue generated by a fee is scheduled to be expended and when the public improvement is scheduled to be completed.
